TERMS AND CONDITIONS

It is your responsibility to familiarize yourself with this Agreement before allowing our technician to begin work. Allowing the Technician to begin the Service constitutes acceptance of this Agreement in its entirety.

Introduction

These Terms and Conditions govern the provision of Appliance Repair Services by “Modern Tech Appliance Repair” (“we” or “the Company”) referring to us, (“you” or “the Customer”) referring to the Customer. By using our services, you agree to these terms and conditions.

Exact time

We will do our best to arrive on time. In the event that we are running late, we will contact you to inform you of the delay. If for any reason we are unable to keep the appointment, we will contact you to reschedule.

Service Fee

A service fee will be charged for each visit to your home, even if the repair is not completed. The customer can request service from the company, and we will send a qualified technician. The service fee is calculated from the time the technician leaves the company and the time needed to analyze the problem (not including repair). A service fee will also be charged in cases where the customer does not wish to proceed with the maintenance process for any reason (for example, it costs more to repair the unit than it is worth). They will be waived if the client decides to accept our quote, pay a deposit and have us do the job. Service fees are non-refundable. The customer will be responsible for the service fee if the problem is caused or may be caused by a source other than the appliance itself: installation issues, plumbing problem, electrical problem, duct obstruction or any other problem not related to the appliance.

For electrical appliances, the service fee is 150 EGP for the first device + 60 EGP for any other additional device in the same house. (Please note that this may vary based on service location and brand)

For gas appliances, the service fee is EGP 200 for the first appliance + EGP 80 for any other additional appliance in the same house. (Please note that this may vary based on service location and brand)

Estimates

We will provide you with a repair report and a price for the service, including parts and labor, before any work is commenced. If additional problems are discovered during the repair, we will provide you with an updated estimate for your approval.

Approval of the reform

A repair cost estimate must be approved before any work can begin. If you refuse to estimate the repair, you will be obligated to pay the service fee.

Complete the maintenance

The repair is considered complete if the customer paid for it in full and/or signed the acceptance form. Payment for the Services in full will also indicate that the Customer has reviewed and tested the Equipment and that the Service has been completed to their satisfaction. We do not offer refunds on completed or ongoing repairs.

Disclaimer

Customer agrees to release Modern Tech Appliance Repair and its owners, employees and technicians from any and all liability, express or implied, arising from damages and expenses of any kind resulting from the repair of Customer’s appliance(s).

Client Responsibilities

a) A person of 18 years of age or older must be present at the time of the service.

b) The customer must have a valid and readily available payment method at all times during the technician’s scheduled visit. We do not accept cheques.

c) The technician must have easy and unrestricted access to the equipment, without interference from children, pets, and other distractions.

d) Customers may not smoke cigarettes near the technician.

Payment

Payment for all work will be made upon completion of the repair process. In the event that the customer refuses to pay after completing the repair process, we will take legal measures that guarantee us the recovery of our rights, with the customer bearing all expenses, including but not limited to attorney fees.

Installation fee

Our standard installation fee covers the removal and/or installation of an appliance without the need to remove any other fixtures. Repair or modification of gas, water, ventilation or electrical systems is not included. We do not verify regulatory compliance with these systems; It is the sole responsibility of the customer. The installation fee mentioned does not include the cost of materials such as ventilation hoses, water lines, gas lines, hoses, fittings, etc. If a second person is needed to install an appliance (for example, washer-dryer or air-conditioning), that additional person’s costs are added to the total bill. The service fee will be charged if installation and installation cannot be proceeded within the specified time.

Spare parts

We use the highest quality spare parts available. If the parts we use fail within the warranty period, we will pay for the parts. If parts fail due to normal wear and tear outside the warranty period, we will charge the usual price for parts and labor. Shipping or handling of parts is not refundable. Electrical or special order parts cannot be returned.

Recommendations

We are not responsible for any work we do not do, even if the customer follows our recommendations.

Warranty terms and conditions

Our 180-day warranty covers only the same issue we’ve tried to fix. It does not cover any other problems, repairs made by others, or malfunctions that were not caused by our faults (eg, voltage fluctuation damage, insects). This warranty is exclusive to the customer and cannot be transferred to any other person. It is considered void in case of improper use, maintenance or transportation of the device. A service fee will be charged if a service technician is sent more than once to address the same warranty issue but cannot find a defect or if it is found to be out of warranty. We reserve the right to decide whether to provide a guarantee. If our technician investigates the fault(s) and finds minor problem(s) unrelated to the workmanship performed by our technician, we will provide you with a quote for the cost associated with the repair. No refunds will be given on labor or parts already provided. Partial refunds may be provided at our discretion. There is no warranty on damage caused by external problems or interference by anyone else tampering with the repair (other than our technicians).


** Please note that the warranty must be activated. Customers will get a 4-month warranty on repairs and spare parts once they receive an invoice and leave their comments through our Facebook page link when the job is done. Customers may have the option to increase their warranty by an additional 2 months by following additional instructions after completing the initial feedback survey, which may increase the warranty to 6 months in total.

LIMITATION OF LIABILITY

We will not be liable for any amounts in excess of the service fee we collect from the customer. In no event shall any party to these Terms be liable for any special, incidental, indirect or consequential damages arising from breach of warranty, breach of contract, negligence or any other legal theory related thereto. The warranty set forth in these Terms is exclusive and supersedes all other warranties, express or implied, including without limitation any warranty of merchantability or fitness for a particular purpose.

DISCLAIMER OF DAMAGES

We are not responsible for damage caused by:

a) Move the device. In the event of a technical request to transport the device, we cannot be held responsible for the resulting damage.

b) Waterproofing. You understand the risks involved in working on appliances connected to a building’s plumbing system. Accordingly, we will not be responsible for accidental leakage and flooding.

c) Defective refrigeration.

d) Lifting the glass burner to reach the parts underneath can lead to breakage for which we will not be responsible.

Terms and conditions for refusal of service

We reserve the right to refuse service to anyone using our reasonable discretion, particularly in cases of disrespectful, annoying customers, or danger to the technician. Service fees may be charged for services refused due to customer fault.

Refunds terms and conditions

All transactions, transfers, sales, parts and services are final unless otherwise authorized in writing by the manager or supervisor. No returns are permitted unless approved in writing by the manager or supervisor.

Credit/Debit Card Disputes and Credit/Debit Card Chargebacks

The customer agrees not to dispute the credit card charges for any reason including the following:

* Unauthorized transaction on the card (this bill serves as evidence of the debit on the card).

* Double charges for the same transaction (This invoice serves as evidence of the charges on the card and any double charges will be shown on the invoice. In this case, the refund will be initiated from our platform only).

* Incorrect amount debited (this bill serves as proof of the debit on the card).

* Unrecognized charges (This invoice serves as proof of charges on the card).

* Continued charges for the canceled service (this bill serves as proof of charges on the card).

* Not receiving a paid product or service (this invoice serves as proof of charges on the card).

If there is a dispute for any reason, the customer agrees to award Modern Tech Appliance Repair. Right of way in the dispute and agrees to withdraw the dispute claim with the credit card issuer.

Modern Tech Appliance Repair. reserves the right to apply administrative fees of up to EGP 1,500 in addition to the original invoice in the event of any disputes initiated on behalf of the client.

Customer agrees to pay all amounts collected, legal costs and fees incurred due to lost disputes.

Administrative fees and accrual of interest for unpaid invoices

Please note that all invoices must be paid upon completion of the work.

If the invoice is not paid at the time of completion of the job, the following administration and interest charges will be incurred:

* Interest is calculated and compounded monthly at the average CIB rate plus 3% or 48% annually (whichever is less) and paid on this amount. It is accrued over the period that begins on the due date and ends on the day preceding the day the payment is received.

* An administration fee and a late fine of up to EGP 1,500 will be automatically applied to the original invoice due date. Please note that all transactions, transfers, sales, parts and services are final unless otherwise authorized in writing by the manager or supervisor.

COLLECTION COSTS

If we incur any legal fees, costs and expenses in an effort to collect our bills, you agree to reimburse us for those expenses, plus interest on the unpaid balance.
